Basic Car & Vans – Rental Agreement Terms & Conditions

1. In this Agreement the following terms shall have the meanings hereby respectively assigned to them:

Hirer: The person named as such overleaf.

Driver: The Hirer and/or other person named as such overleaf or any other person specifically approved by the Lessor to drive the vehicle during the duration of this agreement.

Vehicle: The original vehicle described overleaf or any replacement vehicle.

Accessories: The spare wheel, tools or an other items with which the vehicle is supplied and any replacements thereof.

Rental Period: The period from the date and time out stated overleaf until the re-delivery of the vehicle into the physical custody of the lessor.

Rental Charges: The hire charges for the rental period calculated in accordance with the lessor's current tariff.

Refuelling Charge: A surcharge which is added to the cost of the amount of 'Top-Up' fuel needed when the vehicle is returned to the Lessor. Calculated in accordance with the Lessor's current tariff.

Excess Amount: The sum specified overleaf as the excess amount.

Excess Waiver Fee: A fee calculated in accordance with the Lessor's current tariff which limits the Hire's liability to pay the excess amount to the amount of the non-waivable excess.

Non Waivable Excess: The hire's liability will be limited to the amount of the non waivable excess if Excess Waiver is purchased in accordance with the Lessor's current tariff or is part of an inclusive tariff rate offered by the Lessor.

Personal Accident, Personal Effects & Goods in Transit Insurance Fees: Fees which entitle the hirer to the benefits of the cover set out in the master policies issued to the Lessor.

Current Tariff: The lessor's tariff current at the commencement if the hire.

The Lessor's policy of insurance on the vehicle a copy of which is available for inspection at the rental location.

2. Hirer acknowledges that:

a) The vehicle is fit for his purpose and undertakes to return it and its accessories to the place and on the date due back specified overleaf.

b) He has received the vehicle free from apparent defects or damage (except as indicated overleaf).

c) The lessor has no liability in respect of any injury, loss or damage arising from the use of the vehicle, nor shall the Lessor be liable for any indirect loss or damage, or, in the case of consumers, damage which was not foreseeable by both parties.

d) The lessor shall not be liable for damages arising from defects or mechanical failures which are not attributable to any breach of the manufacturer's warranty or any warranty implied by law to take reasonable skill.

3. During the rental period the Hirer shall keep the vehicle and it's accessories in his/ her's or any approved driver's possession and shall not allow a third party to take possession of the vehicle or its accessories and when not in use the hirer shall keep the vehicle and its accessories adequately protected and secured.

4. The hirer and any driver shall ensure that the vehicle will not be used:

a) For hire or reward

b) For racing, pacemaking, rallying, speed testing, driving tuition or similar purposes.

c) In any matter which might render void the insurance policy, or other contract insurance.

d) For any illegal purpose or in contravention of any legalisation affecting the vehicle, its use or construction.

e) All vehicles when returned will be check over by a member if staff when possible; however, they will have a full check over in the next 48hours and if any faults are found at this stage the hirer will be responsible for the costs and these will be taken from the deposit held. Details of the damage will be sent in a letter with photography evidence where possible.

f) By any person who:

  • Is not licensed to drive the vehicle.
  • Is under 21 years or over 75.
  • Is under the influence of drink or drugs.
  • Has given a fictitious name, age or address.
  • Has not been approved by the lessor as a driver.
  • Has been convicted of a motoring offence the details of which have not been disclosed in writing to the lessor at the commencement of the hire.

g) Outside England, Wales or Scotland without prior consent of the Lessor.

5. The hirer agrees to pay on demand.

a) Rental Charge

b) Any appropriate Excess Waiver or Personal Accident, Personal Effects or Goods in Transit insurance fees, and any Refuelling and miscellaneous charges.

c) The excess amount in respect to each incident resulting in damage to or loss of the vehicle, it's accessories or any property left stored or transported in or upon the vehicle, save to the extent that such damage or loss arises from the actions of the Lessor.

d) All fines, charges, penalties, costs and expenses (including all charges and penalty charges incurred under the charging scheme) incurred in relation to the vehicle by the hirer or Lessor, except where caused through the fault of the Lessor.

e) Any Value Added Tax, local or other taxes payable in respect of any of the above.

6. The Hirer shall compensate the Lessor in full on demand for any loss it suffers as a result of any damage, fire or theft to or of the vehicle including loss of revenue to the Lessor for the period during which the vehicle shall remain unavailable for rental by reason of such matters and any claims made by any persons in respect of the vehicle whilst in the Hirer's custody. This clause applies whether you have insurance or not. This clause shall not apply to any loss caused by or the responsibility of the Lessor.

7. The Hirer and any driver shall:

a) ensure compliance with the terms, conditions and limitations of the insurance policy, which shall be deemed to be included in this agreement as if the same were fully set out herein.

b) Inform the Lessor of any loss of or damage to or fault developing in the vehicle as soon as the Hirer or driver becomes aware of the loss, damage or fault.

c) At the request and cost of the Lessor permit to be done in his own name all acts and things as may be reasonably required by the Lessor for the purposes of repairing the vehicle or enforcing any rights or remedies or of obtaining relief from other parties in respect of any loss os damage to or any driver.

d) Indemnify the Lessor against such loss as is recoverable at law where that loss is incurred by reason of a breach of this Agreement by the Hirer or any driver.

e) Ensure that the maximum payload and individual axle plated weights are not exceeded.

f) Be responsible for the loading or unloading of the vehicle.

g) Obtain or maintain any necessary operator's licence.

8. The Hirer and any driver shall not:

a) Without prior consent from the Lessor incur any liability for repairs to the vehicle in excess of £25.

b) Be the agent or servant of the Lessor for any purpose.

c) Make any claim or the loss of or damage to any property left stored or transported in or upon the vehicle unless due to our negligence.

9. Even if an excess waiver fee is paid, the Hirer shall be responsible for payment of any excess amount where the loss of or damage to the vehicle or its accessories arises from the negligent or wilful action of the Hirer or any driver.

10. The period of hire a specified overleaf shall not be extended without the Lessor's express authorisation in writing and in any event the period of this Agreement shall not exceed 90 days.

11. If the Hirer does not comply with any of the material conditions of this Agreement he/she shall return the vehicle to the Lessor immediately and pay to the Lessor on demand such loss is recoverable at law where that loss is caused by the Hirer's non-compliance. Where the Hirer fails to return the vehicle the Lessor shall be at liberty to retake possession of the vehicle and all reasonable costs and expenses incidental to recovery of the vehicle shall be paid by the Hirer to the Lessor on demand.

12. Any addition to or alteration of the terms and conditions of this agreement should be agreed upon the writing parties.

13. Nothing in these terms and conditions shall be deemed to exclude or restrict the Lessor's liability for death or personal injury resulting from negligence or any other liability of the Lessor on demand.

14. Van & Car Hire Payment Process

Full payment for the hire must be made by Credit or Debit card

Bookings are not confirmed or guaranteed until the full hire charge has been paid

All cancelled hires will be subject to a £25 admin charge; however, the below will also be applied at the manager's discretion.

  • 50% of the full booking cost to be taken if cancelled under 48 hrs before hire
  • 100% of the full booking cost to be taken if cancelled under 24hrs
  • NO shows will have card charged for full amount of failed booking

An insurance excess or deposit will be authorised against the card and automatically refunded on return of the vehicle if it is undamaged subject to hirers bank terms of payments on hold.

    Additional Car & Van and Classic & Prestige Car – Rental Agreement Terms & Conditions

    Insurance Restrictions

    Wallis Rentals provides fully Comprehensive insurance for all drivers stated on the rental agreement, subject to our terms and conditions. Under no circumstances can any of Wallis Rental's vehicles be covered under your own insurance without prior written consent to do so.

    If the driver holds a EU licence this will need to be referred to our insurance company before the hire is confirmed.

    Age Restrictions

    All insured drivers must be between 30 and 75 years of age.

    Licence Restrictions

    Drivers must:

    • Hold a current valid British full driving licence and must have held same for at least 2 years.
    • Not have been convicted of any of the following motor offences: AC/BA/CD/DD/DR/UT/XX within the last five years or convicted of more than one of the following motor offences in categories CU/IN/LC/MS/MW/PC/PL/SP/TS in the last three years.
    • Not have been in more than one accident in the last three years.
    • Not have any more than 6 current points on their driving licence.

    Health Restrictions

    Drivers must:

    • Be in physical condition so as to be reasonably considered of driving a performance car safely.
    • Not have any mental or physical defect or infirmity or suffers from fits, diabetes or any heart related condition.

    Your Responsibilities

    • You must look after the vehicle, keys and always use any security device provided with the vehicle.
    • Make sure the correct fuel is used.
    • Make sure the vehicle oil level is not low (running the car with low oil could damage the car).
    • Before returning a vehicle it is your responsibility to make sure you haven't left any items of value or personal belongings in the vehicle.

    Liability

    Wallis Rental's liability is limited to a refund of the hire charge. No consequential loss liability will be covered. Car hire may be cancelled or re-arranged if:

    • The weather is deemed inclement and there for not suitable for hire by Wallis Rentals, a suitable replacement date will be arranged or your hire refunded in full.
    • There is a mechanical breakdown of the car, if this occurs and it is feasible to offer an alternative car for the hire we will do so and will reimburse the cost difference for the hire of the substitute vehicle, should we not have another vehicle available or if you choose to not have the replacement offered we will either re-arrange the hire for another day or reimburse you in full for the cost of the hire, Wallis Rentals accept no responsibility or liability for cancellations under these conditions.
    • Wallis Rentals retain the right to refuse hire of our vehicles to any one we deem unsuitable for hire or whom we feel do not fit our criteria for hire or if the hirers age or licence details do not comply with out terms as set out herein.

    Use of Vehicle

    The hirer may use the vehicle for the purpose of their business and for social domestic and pleasure purposes. The vehicles may not be used for any purposes for which they are not expressly designed. Further, the hirer will not use or permit the vehicles to be used for hire, driving tuition, racing or pace-making, or for competing in any rally, or any other form of motor sport, track days, or for any illegal purpose whatsoever. Allowing a non-insured driver to drive our vehicle will result in the loss of your security bond. Wallis Rentals will also view this as theft of the vehicle and will prosecute with out exception in all cases as theft.

    Booking Fee

    We require a Booking Fee of £100 to reserve the vehicle, which will be deducted from the cost of hire on payment. Refunds upon cancellation are subject to the cancellation terms below.

    Bookings are only confirmed when paid for in full, bookings must be paid for in full at least 14 days before hire commences or at the immediate time of booking if booking is within less than 14 days hire.

    Collection and Delivery

    Cars can be collected from the storage facility, where we have parking should you wish to leave your car, or we will deliver at an additional cost. We will Endeavour to keep to a hirers requested time frame as much as possible, however due to the nature of road transport this may be subject to delay in some cases. Wallis Rentals cannot be held liable for delivery or collection delays for reasons beyond our control.

    Booking Changes

    In unforeseen circumstances it may become necessary for changes to be made to the hirers booking. This may be the upgrade or downgrade of a vehicle, price adjustment or change of date or cancellation in the case of dangerous weather or unforeseen issues.

    Cancellation

    On cancellation of a booking the following conditions apply:

    • Up to 14 days prior to hire date the customer is eligible to a 100% refund of the balance of hire subject to a minimum £100 cancellation fee.
    • 7 days prior to the hire date the customer is eligible to a 50% refund of the balance of hire subject to a minimum £100 cancellation fee.
    • 48 hours prior to the hire date the customer is not eligible to a refund at all and will lose the full balance of hire and deposit.
    • Please note that in all cases a cancellation will result in the loss of the £100 booking cancellation fee.

    Excess & Security Deposit

    As a security bond

    As payments towards any mechanical damage which is not covered by our Insurers, i.e. tyres, wheels, clutch, gearbox, which was sustained during the hire period, excluding normal wear and tear, due to misuse and abuse.

    As an insurance excess against any accidental damage or loss caused to the vehicle by a third party or the hirer. The hirer is liable for the amount shown as Excess Deposit.

    Additional charges incurred during hire for excess mileage and, or, petrol reimbursement charges. The Excess Security Deposit is as per the tariff. Security deposit can be held against a major credit / debit card / cash and will be refunded immediately after the hire (subject to terms listed) so you do not incur any charges. The security bond will only ever be fully held if any damages to the vehicle result in an insurance claim, in all other instances the cost of the damage only will be deducted.

    Fuel / Refuelling

    You will be provided with a full tank of fuel and the vehicle must be returned with a full tank. If, however, this is not the case any reimbursement for fuel will be charged accordingly to our standard fuel charges. A £25 administration fee is added to this price.

    Oil & Water

    All cars will be provided with oil and water levels at the optimal levels. Hirers must not add any fluids to the vehicles without Wallis Rentals prior consent with the exception of fuel. Cars are only to be re-fuelled with a correct grade of petrol as recommended by the manufacturer.

    If general levels of fluids (engine coolant, screen wash), engine oil, brake, power steering and clutch fluids are required during drive time the hirer must contact Wallis Rentals immediately. Failure to comply may result in serious damage to the car for which an owner may be held financially responsible.

    Overseas Travel

    Please note none of our cars may be taken out of the UK with out express written permission. Ireland (Eire) is not part of the UK, our cars are also excluded from Northern Ireland, the Channel Islands and the Isle of Wight unless by prior arrangement.

    Identification

    Driving licence needs to be provided to Wallis Rentals before hire can commence for all named drivers, also Photo ID in the form of a Passport and a utility bill or credit card statement must also be produced as confirmation of ID, these can be sent by registered mail to our offices, they will be photo copied and returned by registered mail, photocopies are acceptable BUT the originals must be produced on the day of hire, failure to do so would cancel the hire. If upon delivery these documents have not been received or viewed by Wallis Rentals the hire will be cancelled and our cancellation policy will apply, Wallis Rentals will also take a photo of any hirer or driver for our records, failure to comply with this request will result in the cancellation of the hire and our cancellation policy coming into force.

    Mileage Allowance

    Cars & Vans we apply a 200 mileage allowance to your first day, then an additional 150 miles per day thereafter capped at 1000 miles for the first week. Subsequent weeks are 500 miles per week. Any mileage over this will incur a fee of £0.25p per mile, so for example, for an extra 50 miles, it is £12.50. If you are renting for longer than a week please check with our rental advisors. Our prestige and classic vehicles' mileage allowance is 150 miles per day, and anything above this is charged at £2.00 per mile or £1.00 per mile if pre-booked.

    Additional Drivers

    1 driver is permitted as standard and 2 additional drivers may be added to the rental agreement at the cost of £55 per day provided that the additional named drivers meet the criteria as per our terms & conditions.

    Wallis Rentals reserves the right to refuse hire without reason.

    Extending Hire

    If one wishes to extend their hire midst their rental period, he or she are required to pay for the extension and sign a new booking confirmation before the end of the original rental agreement and extension of hire takes place. Under no circumstances will Wallis Rentals allow the hirer to take the extension of hire without payment.

    Speeding Tickets / Parking Fines

    The driver / hirer of the vehicle hereby agrees that he or she shall be liable for all speeding fines and or parking tickets or any other costs or penalties that may be incurred whilst the car is in the position of the hirer or in relation to the manner in which the hirer / driver has driven the car during the hire period.

    Late Return Charges

    Cars returned late of agreed return time will be charged a late returns charge of £50 every successive 30 minutes.

    Congestion Charges

    Congestion charging in London and various other cities has become common practice. The hirer is responsible for paying these charges; failing to do so gives Wallis Rentals the right to debit the hirers credit card for any congestion charges incurred.

    Smoking in Vehicles

    Smoking in our cars is extremely forbidden and any indication will result in the full loss of your Security Bond

    Damage Wear & Tear

    All damage to our cars whilst in the custody of the hirer how ever they arise will be the responsibility of the hirer and Wallis Rentals will charge for the cost of the repairs against the Security Bond held against the hire up to the value of the security bond, if requested Wallis Rentals will provide a quotation for the works from a repair specialist. Any excess wear to the cars tyres will be charged at a pro rata rate for the cost of replacing the tyres, Wallis Rentals will provide details of these Charges should they apply, these charges also extend to unreasonable wear and tear on any other part of the car. Vehicles are only fully inspected once returned to our premises, this is due to dirty vehicles / bad light which hamper a full inspection at the clients address, any damage discovered once we have cleaned the vehicle will then be charged, Wallis Rentals are not limited to noting the damage at the time of pick up of the vehicle for the reasons set out in this clause.

    Wallis Rentals have the right to hold the hirers security bond until any repairs or insurance claims have been settled. In cases of extensive damage the hirer will lose the full security bond.

    All cars will be rigorously checked prior to and following each drive period and readings taken in relation to tyre tread depth and condition (inc spare), wheel condition, bodywork and paintwork condition, interior and trim condition, fluid levels, clutch wear percentage (by electronic system), glass condition, electrical, mechanical and hydraulic systems. If any hirer is deemed to have caused unacceptable wear and or damage to the car through negligence or deliberate action, additional charges will be made.

    If damage to tyres occurs the hirer must not drive the car and must contact Wallis Rentals office to arrange for a replacement to be fitted. In the case of punctures, the cause will be assessed and if the puncture is found be caused as a result of owner negligence then the owner will be charged accordingly. Tyres that are found to have been worn or damaged as a result of misuse will be charged for.

    If any car is damaged in any way while in the possession of a hirer, then the hirer must report the damage to the office immediately. If damage is such that the car may not be moved, the hirer must not abandon the car but will firstly ensure their own safety and that of any passengers and if possible secure the car then stay with it until assistance arrives.

    Damage however caused will be charged for: Wheels/tyres £125 each, Smoking in vehicle £500, Burns caused by smoking to interior £1000 plus repair costs. You will be responsible for the cost of loss of hire of that vehicle due to damage to a maximum of 3 weeks hire charge.

    A garage appointed by Wallis Rentals will carry out all repairs; this will be our local workshop as used for all repairs. The rate for works is £150 p/h. If they are unable to complete the repairs the vehicle will be taken to an official dealership connected to that make of car.

    All cars have the option to turn off the ABS/traction control, should these be activated by the hirer, and an accident occurs due to the hirers’ actions the hirer will be fined £10,000, in addition to the insurance excess if another vehicle is involved. If no other vehicle is involved the hirer will be liable to this fine in addition to the repair and hire costs highlighted in section 4 above.

    You will also be responsible for the cost of loss of hire of that vehicle to a maximum of 3 weeks hire charge.

    All vehicles when returned will be check over by a member if staff when possible, however they will have a full check over in the next 48hours and if any faults are found at this stage the hirer will be responsible for the costs and these will be taken from the deposit held. Details of the damage will be send in a letter with photography evidence where possible.

    Accident / Mechanical Difficulties / Theft

    In the case of the breakdown or mechanical problems you must contact Wallis Rentals immediately. No repairs or replacement vehicle are allowed without permission from Wallis Rentals.

    If you are involved in an accident or the vehicle is stolen you MUST contact the local police and Wallis Rentals immediately. Please keep a copy of all relevant documents you are asked to complete. DO NOT ADMIT LIABILITY IN ANY FORM.

    Vehicle Break Down

    In the event that a vehicle breaks down or is damaged and not drivable, Wallis Rentals will if possible provide a replacement vehicle. If a suitable replacement is not available at the time of break down then the hire will be terminated and Wallis Rentals will recover the vehicle. An alternative date for the hire will be offered or a credit for the remaining days will be issued.

    Tracking

    For security reasons all cars are fitted with tracking devices. Wallis Rentals reserve the right to periodically check on the location of any car. In addition the tracking devices will notify us automatically should any car be taken to a location where racing, pace making, or other prohibited used may occur and an automatic engine immobiliser will be activated. Should this occur the hirer will be subject to a fine of £5000. In addition systems exist within all Wallis Rentals cars that will record parameters relating to driver safety. These systems will report extreme exceptions to the manufacturers stated acceptable use of cars and may be utilised to prohibit continuous inappropriate activity.

    UK and European Use

    Cars are only permitted to be used for social, domestic or pleasure use only. The cars are not to be taken outside of the UK without our prior consent as the insurance will not be valid in Europe. In addition the tracking devices will notify us automatically should any car be taken outside the UK and an automatic engine immobiliser will be activated. Should this occur the hirer will be subject to a fine of £5000. Should the hirer wish to use the car in Europe he must seek written authorisation from Wallis Rentals and we will supply the correct insurance.

    Cars may not be taken out of England, Scotland or Wales without written authorization or prior approval from us.

    Vehicles taken abroad will be subject to a rate surcharge and additional insurance cover of £25 + vat per day.

    Fuel and refueling

    Fuel will be charged at RRP

    A £25 administration fee will be applied to all refuels

    Additional drivers

    At the cost of £55 per day

    Collection and delivery and Vehicle returns

    If Wallis Rentals has agreed for the vehicle to be returned outside of office hours, the hirer will remain responsible for the vehicle and its condition until it is re-inspected by a member of our staff.

    If Wallis Rentals has agreed the vehicle may be returned to another location, it is the hirer's responsibility to inform Wallis Rentals that the vehicle is ready for collection and to park the car safely and legally until the vehicle is collected.

    The hirer will remain responsible for the vehicle and its condition until it is re-inspected by a member of our staff.

    Parking, Traffic and other speeding offences / fines

    Where possible, all fines and penalty notices will be represented to the hirer. An admin fee of £25 will apply.

    All fines and court costs for parking, traffic or other offences (including any costs which arise if the vehicle is clamped or towed) are the responsibility of the hirer.

    If these fines are not paid, a £35 administration charge per offence will apply.

    If the hire vehicle is impounded, the hirer will be liable at the advertised daily tariff rate until vehicle is released.

    Terms & Conditions for Camper Vans

    Wallis Rentals - Terms and Conditions 2021

    We aim to provide you with the best possible Campervan hire experience. To help you make the most of your holiday we have written these terms and conditions as simply and openly as possible. It is important that you read this agreement carefully.

    EU licences need to be checked by our insurance company before hire is confirmed.

    1 DEFINITIONS

    1.1 'This agreement' means the Rental Agreement and these Terms & Conditions.

    'You' and 'the customer' and 'the driver' and 'the hirer' means the person or persons nominated as the hirer and any person whose credit card is presented for payment of the customer's charges.

    'Named Driver(s)' means the hirer and any other specified individual named in the on the Booking Form and who have signed these Terms prior to any hiring.

    'Hire period' means the rental period or any agreed variation thereof and any additional period during which the vehicle is in the customer's possession or control.

    'Vehicle' means the Vehicle hired by the customer and includes tyres, tools, accessories & all other equipment or documents or additional hire items related to the Vehicle.

    2 YOUR CONTRACT

    2.1 Your contract is with Wallis Rentals and it exists when we confirm your booking. The booking will be confirmed when we have received the booking form, all other required documentation, and the booking deposit in cleared funds.

    2.2 You should check the details of your confirmation letter carefully to ensure that it reflects the booking you have requested and immediately inform us of any discrepancies.

    2.3 If you commit any breach of this agreement, we may treat the agreement as terminated and may seize, without legal process or notice to you, the Vehicle at any time and place. You waive all claims for damages connected with such a seizure.

    2.4 The Hirer and Named Drivers are required to sign to say they have read and understood these Terms and Conditions.

    3 RATES & CONDITIONS

    3.1 Prices and conditions quoted on our website are subject to change without notice.

    3.2 All prices quoted and payable in UK pounds sterling.

    3.3 Once you have made your booking and paid the deposit, the cost of your hire will not normally be subject to any change. This does not apply to invoice errors or omissions.

    3.4 Once a booking has been made, offers and discounts cannot be applied retrospectively.

    3.5 The balance of the price of your hire must be paid in full as cleared funds no later than 14 days before the date of hire.

    3.6 If the balance is not paid in time, we may cancel your booking and retain your deposit.

    3.7 All Named Drivers must produce their full UK driver's licence (photocard) AND 2x confirmation of address (less than 2 months old) at the time of hire. For each named driver the address on the driving licence must be the same as on the utility bill.

    3.8 If the documents listed at clauses 3.7 are not available, we will be unable to proceed with the hire as we are governed by our insurer's requirements.

    3.9 The Hirer accepts full responsibility for the Vehicle and equipment throughout the period of the hire and shall be fully responsible for the cost of repairs or, if necessary, a replacement Campervan if loss or damage occurs as a result of any act or omission which results in a breach of these Terms.

    4 EXTRA DRIVERS

    4.1 1 driver is permitted as standard and 2 additional drivers may be added to the rental agreement at the cost of £10 per day provided that the additional named drivers meet the criteria as per our terms & conditions.4.2 It is illegal for an undeclared driver to operate or drive a rental Vehicle, as they will not be insured.

    5 HIRE PERIOD & DURATION

    5.1 We calculate rental days on a nightly basis.

    5.2 Late pickup or early return of the Vehicle does not entitle you to any refunds.

    5.3 We allow a discretionary grace period of 1 hour before the customer is liable for any late return charges. Late return charges are £30 per hour if you are up to 4 hours late. More than 4 hours late, one full days hire rate will apply.

    5.4 If the hirer expects to be late returning the Vehicle, Wallis Rentals must be informed by telephone as soon as is reasonably possible.

    6 DELIVERY AND RETURN OF THE VEHICLE

    6.1 You will acknowledge having received the Vehicle in a clean condition and with a full fuel tank. You will be required to sign the "Condition and Inventory" form when you collect the Vehicle which details the condition of the Vehicle and equipment at the start of the hire. It is the hirer's responsibility to ensure that damage to the Vehicle and equipment, or missing equipment, is detailed on this form before it is signed.

    6.2 You will return the Vehicle in a clean condition with a full tank of fuel, on the return date, time and location set out in the rental agreement.

    6.3 The customer acknowledges that we will reasonably determine what, if any, refund may be warranted if the Vehicle is returned or the customer ceases to have the use of the Vehicle prior to the return date.

    6.4 The hirer may collect the Vehicle at 2pm on the hire start date. Please allow one hour for the hand over, to complete the paperwork and to be shown around the Vehicle.

    6.5 The hirer must return the Vehicle by 10am on the final day of the hire. Please allow 15 minutes to return the Vehicle, to have it checked and complete the paperwork.

    6.6 Please consider that the next customer may be collecting the Vehicle within hours of your return time.

    7 OPENING TIMES

    7.1 Our opening hours are 830am to 6pm Monday to Friday and 830am to 1230pm Saturdays. We cannot guarantee to be available outside of these hours, but we will try to offer as much flexibility as possible.

    8 DRIVERS

    8.1 You may only drive a hire Vehicle if:

    8.1.1 You are aged between 25 and 75.

    8.1.2 You hold a full UK/EU driving license and have not been disqualified.

    8.1.3 You have held a full driving license for more than 3 years.

    8.1.4 You have not been convicted of any criminal / driving offences other than up to two speeding offences in the last three years and parking offences.

    8.1.5 You have had no more than one motor accident in the last 3 years.

    8.1.6 You do not suffer from any mental or physical defects or infirmity or suffer from fits, diabetes or any heart complaint.

    8.1.7 You have never had insurance declined and/or renewal refused and/or special insurance terms imposed as a result of claims experience and/or have had your insurance or cover cancelled by any Motor Insurer.

    8.1.8 You are not employed in a 'high risk' occupation as defined by our insurer. Please inform us of your occupation at the time of making the provisional booking and we will check your occupation before confirming your booking.

    8.1.9 You produce your driving license upon collection of the Vehicle.

    8.1.10 You are a named driver on the Rental Agreement.

    8.1.11 You authorise us to verify through credit agencies, the Driver and Vehicle Licensing Agency, your employer or any other sources to your personal, driving and credit information.

    8.2 We may refuse to hire you the Vehicle for any reason whatsoever at our sole discretion.

    9 CANCELLATION OF YOUR BOOKING

    9.1 You will incur the following charges if you cancel your booking;

    9.1.1 Cancellation more than four weeks before your arrival date, cancellation charge is the booking deposit of £100.

    9.1.2 Cancellation between four and two weeks before your arrival date, cancellation charge is 50% of total cost. 9.1.3 Cancellation less than 14 days before your arrival date, including if the hirer does not collect the Vehicle on the hire start date, cancellation charge is 100% of total cost.

    9.2 You may cancel your booking at any time with written notification.

    9.3 Where a refund is due to you we will make the refund within 7 days of receiving notice of cancellation.

    9.4 Note that if the reason for cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim these charges. We strongly recommend that you take out separate travel insurance.

    10 CHANGES TO YOUR BOOKING

    10.1 If, after we have confirmed your booking, you wish to change your travel arrangements in any way we will do our utmost to make these changes, but it may not always be possible.

    10.2 The price of your hire may increase or decrease to reflect the changes made.

    11 IF WE CHANGE OR CANCEL YOUR BOOKING

    11.1 It is sometimes inevitable that we will have to change or cancel your hire as the arrangements are made some time in advance. We reserve the right to make such changes should they become necessary but will do everything we can to minimise the chance of such an event.

    11.2 Most of these changes will be minor, for instance changes to the specification of our campervan.

    11.3 Wallis Rentals reserves the right to cancel a reservation without refund at the proposed commencement of hire if: 11.3.1 A full clean UK driving licence is not produced or valid in accordance with these Terms.

    11.3.2 The Security Deposit is not paid before the Campervan is made available.

    11.3.3 The full and final balance has not been paid.

    11.3.4 The number of people in the Hirer's party exceeds the maximum permitted capacity of the Vehicle. 11.3.5 The address on the Hirer's driving licence does not match the booking or billing address.

    11.3.6 Hirers from outside the UK fail to provide a valid passport.

    11.3.7 The Hirer or named drivers refuse to sign these terms & conditions.

    12 USE OF THE VEHICLE

    12.1 While you are hiring the Vehicle you, and the Named Driver(s), will not:

    12.1.1 Operate the Vehicle, or permit the Vehicle to be operated in any way that would violate this agreement.

    12.1.2 Permit anyone other than Named Driver(s) to drive the Vehicle.

    12.1.3 Engage in motor sports, including racing, pace making, rallying, reliability trials, and speed testing.

    12.1.4 Propel or tow any Vehicle, trailer or caravan.

    12.1.5 Drive or permit to drive any person unfit through drink or drugs or with blood alcohol concentration above the limit prescribed by road traffic legislation.

    12.1.6 Leave the Vehicle unlocked while unattended, or fail to secure the keys.

    12.1.7 Drive other than on a paved public highway, private road, or driveway.

    12.1.8 Drive in a reckless or imprudent manner.

    12.1.9 Carry more passengers than the seating capacity of the Vehicle.

    12.1.10 Allow the Vehicle to be overloaded.

    12.1.11 Carry passengers or goods for hire or reward.

    12.1.12 Smoke or permit anyone to smoke in the Vehicle. A charge of £950.00 will be made when the No Smoking policy is ignored.

    12.1.13 Use the Vehicle in violation of any law, ordinance or regulation.

    12.1.14 Remove the Vehicle from mainland England, Scotland or Wales without prior written consent from Wallis Rentals.

    12.1.15 Allow any animals in the Vehicle without our prior written consent.

    12.1.16 Drive, or allow the Vehicle to be driven by the Named Driver(s), unless each passenger is using one of the seatbelts provided.

    12.1.17 Use the Vehicle for the carriage or storage of goods of an explosive, dangerous or hazardous nature.

    12.2 You will take all reasonable steps to maintain the Vehicle, ensuring that the oil level, water level & tyre pressures are correctly maintained during your hire. You will contact us immediately should any Vehicle warning lights indicate a potential malfunction.

    12.3 Cars & Vans and Campers we apply a 200 mileage allowance to your first day, then an additional 150 miles per day thereafter capped at 1000 miles for the first week. Subsequent weeks are 500 miles per week. Any mileage over this will incur a fee of £0.25p per mile, so for example, for an extra 50 miles, it is £12.50. If you are renting for longer than a week please check with our rental advisors.

    12.4 The Vehicle must never be taken through a car wash, or washed using a pressure wash. If the hirer breaches this clause any damage to paintwork and the resulting costs incurred shall be passed on in full to the Hirer and must be paid within 10 working days of demand.

    13 IN THE EVENT OF A BREAKDOWN

    13.1 You should inform Wallis Rentals by telephone.

    13.2 You are authorised to approve repairs up to £50.

    13.4 Any repairs in excess of £50 must first be authorised by us, prior tothe work being undertaken.

    13.5 In all cases receipts must be submitted for any repair or the claim willnot be paid.

    13.6 We will not be liable for the cost of any repairs, or other costs incurred,resulting from reckless or imprudent use of the Vehicle.

    13.7 You will notify us by telephone of the breakdown within 24 hours inorder to give us the opportunity to rectify the problem during the rental.

    13.8. Wallis Rentals will refund the appropriate proportion of your hire fee, we will not be liable for any other costs incurred.

    13.9 You will be liable for any cost associated with the incorrect use of fuel(fuel being petrol or diesel) or water contamination of fuel.

    13.9.1 The customer will pay Wallis Rentals the daily rate for the period the Vehicle is off fleet for repairs.

    14 IN THE EVENT OF A PUNCTURE OR DAMAGE TO TYRES

    14.1 You are liable for the cost of any tyre damage or punctures.

    14.2 In the event that a tyre is returned damaged, at the end of your hire, it will be at our discretion whether to repair or replace it.

    14.3 If you have a puncture during your hire you may use the breakdown service to replace the tyre.

    14.4 You will arrange for the puncture to be repaired, or the tyre replaced, as soon as possible after the incident.

    15 IN CASE OF ACCIDENT

    15.1 If you are involved in a motor Vehicle accident the following procedures should be followed: 15.1.1 Obtain the names and addresses of third parties and witnesses.

    15.1.2 Report the accident to the police, regardless of estimated cost.

    15.1.3 Do not accept blame or insist the other party is at fault

    15.1.4 If possible photograph damage to all Vehicles involved and registration numbers.

    15.1.5 Phone our office within 2 hours.

    15.1.6 At our office hand over any police reports or photographs, pay the damage excess charge (if applicable). We will ensure that an Accident Report is completed clearly and signed by the customer.

    15.2 We will endeavour to ensure any money due back to you is forwarded as quickly as possible, however 3rd party claims can take a long time to resolve.

    15.3 You agree to provide all reasonable assistance to Wallis Rentals in handling any claim including providing information and attending Court to give evidence.

    15.4 Note: under no circumstances should you attempt to start or drive a Vehicle that has been involved in an accident, roll over or submersion without our permission.

    15.5 Wallis Rentals cannot accept liability for any cost arising from any accident, theft or vandalism.

    16 VEHICLE TITLE AND OWNERSHIP

    16.1 The customer acknowledges that Wallis & Son Ltd retains the title to the Vehicle at all times, and the vehicle remains the property of Wallis & Son Ltd at all times. You will not attempt, agree, offer or purport to sell, assign, sublet, lend, let on hire or otherwise part with or attempt to part with the possession of the Vehicle.

    17 PERSONAL INJURY

    17.1 Wallis Rentals does not accept liability for personal injuries sustained during rental. We strongly recommend that all customers take out personal travel insurance.

    18 INSURANCE

    18.1 The customer understands that:

    18.1.2 You are not covered for damage to your own personal property - we strongly recommend that you take out personal travel insurance to cover your own possessions.

    18.1.3 The Vehicle is covered against accidental damage by fire, theft or attempted theft during the period of hire. 18.1.4 There is a damage excess charge of £750 applicable to each claim.

    18.1.5 The following are not covered by insurance: damage to tyres by punctures, cuts or bursts.

    18.1.6 Theft involving deception, theft as a result of keys remaining in the Vehicle whilst it is unoccupied is not covered by the insurance.

    18.1.7 The cost of accidental damage not caused by fire or theft is subject to a £750 damage excess charge.

    18.1.8 Any claim on insurance will not be considered if the Vehicle was being used in contravention to these terms and conditions.

    18.2 The damage excess charge of £750 is applicable regardless of who is at fault and must be paid at the time the accident report is completed, not at completion of the rental. The damage excess charge will be refunded only if we are successful in recovering the cost of the damages from the third party.

    18.3 The Vehicle is insured for the agreed period of hire only, if you return the Vehicle late you will not be insured and you may be committing a traffic offence under the Road Traffic Act.

    18.4 If you are forced to return late you must notify us by telephone before your agreement expires.

    18.5 Exclusions from the insurance policy, for which you will be totally liable and from which you indemnify us, include:

    18.5.1 Any damage to the interior of the Vehicle (including cigarette burns, spillages, marking), living or cooking equipment will be charged to you and taken from the damage deposit.

    18.5.2 Any costs resulting from the improper use of the Vehicle.

    18.5.3 Any fines or penalties resulting from an offence against the Road Traffic Regulation or Offenders Act, and for any Congestion Charge penalties incurred.

    18.5.4 Any damage caused to the Vehicle above cab height.

    18.5.5 The cost to retrieve or recover a Vehicle that has become bogged.

    18.5.6 The cost of replacing keys, which have become lost or stolen, or which have been locked in the Vehicle.

    18.5.7 The cost of repairing any damage caused by wilful misconduct (eg sitting on the roof).

    18.6 You are strongly advised to take out additional travel insurance, as you may be able to claim against it for such exclusions should the need arise.

    19 SECURITY DEPOSIT

    19.1 You authorise Wallis Rentals to deduct from the security deposit any amounts due to them arising out of the agreement. The security deposit is £1,000.

    19.2 The security deposit may be paid by cash or by bank transfer.

    19.3 The security deposit will be refunded within seven days of return provided;

    19.3.1 There is no damage to the Vehicle, including the windscreen or tyres.

    19.3.2 No damage has been caused by the Vehicle, Hirer or Named Driver(s) to any third party.

    19.3.3 There is no malfunction or breakdown of the Vehicle, and no repairs are required to the Vehicle, caused by any negligent act or omission of the Hirer or any other member of the Hirer's party.

    19.3.4 The Vehicle is returned to the location agreed with Wallis Rentals, on the agreed date and by the agreed time.

    19.3.5 The provided equipment and contents of the Vehicle are returned in the same condition as when it was collected, with the interior, all cooking utensils and all camping equipment cleaned.

    19.3.6 The Vehicle is returned with a full tank of fuel.

    19.3.7 No additional costs have been incurred by Wallis Rentals during the period of rental (for example, as a result of a violation of traffic laws or regulations).

    19.3.8 The Hirer and Named Driver(s) have not incurred any fines or penalties in connection with clause 21.1 below or any other charges unforeseen by Wallis Rentals.

    19.4 We reserve the right to retain fees from the security deposits:

    19.5.1 Soiling fee £500 if the Vehicle is not returned with the interior in a clean condition.

    19.5.2 Fuel surcharge if the tank is not returned full (empty £130, 25% £100, 50% £70, 75% £40 when diesel £1.50/ltr). Plus a handling fee of £20.

    19.5 In the event that the security deposit is insufficient to meet all costs associated with noncompliance of clauses 19.3.1 to 19.3.8 the Hirer must pay all additional costs over and above the amount of the Security Deposit to Wallis Rentals within 10 working days of demand.

    20 RELEASE & INDEMNITY

    20.1 The customer releases Wallis Rentals its employees and agents, from any liability to the customer (regardless of who is at fault), for any loss or damage incurred by the customer by reason or rental, possession or use of the Vehicle.

    20.2 The customer indemnifies Wallis Rentals, its employees and agents, against any claims, demands and expenses (including legal costs) incurred or sustained by them by reason of the customers use and/or possession of the Vehicle.

    21 ROAD TRAFFIC ACT

    21.1 You are entirely responsible for any speeding, parking, congestion charge or other road fines and penalties incurred during your hire.

    21.2 The administration fee per incident will be £50. such charges.

    22 DATA PROTECTION

    22.1 You agree that Wallis Rentals may use your personal information for administrative purposes and disclose this information to its service providers and agents including (but not limited to) its insurers, credit reference agencies and the driver and Vehicle Licensing Authority; for any purpose authorised under the Data Protection Act 1998.

    23 TERMINATING THE AGREEMENT

    23.1 You acknowledge that we may terminate this agreement and repossess the Vehicle at any time without notification to the customer. The customer will pay reasonable costs of repossessing the Vehicle. We may repossess the Vehicle if: 24.1.1 You are in contravention of this agreement in any manner, or

    23.1.2 We believe that you have hired the Vehicle through fraud or misrepresentation, or

    23.1.3 The Vehicle appears to be abandoned, or

    23.1.4 The Vehicle is not returned on the agreed day or we believe that the Vehicle may not be returned on the agreed date, or

    23.1.5 On reasonable grounds, we believe that the safety of the passengers or condition of the Vehicle is endangered. 24.2 You understand that, in the event of such termination or repossession you have no right to a refund of any part of the rental charges or the security deposit.

    24 COMPLAINTS

    24.1 Wallis Rentals are contactable throughout the rental period. All faults, damage or complaints must be reported by telephone, as soon as is reasonably possible, on 01223 263911, or at the latest on return of the Vehicle.

    24.2 In the event that a complaint is not satisfactorily resolved when the Vehicle is returned, the Hirer must inform Wallis Rentals in writing within 14 working days.

    25 LAW

    25.1 This agreement is governed by the laws of England.

    25.2 The customer warrants that all information supplied by them to Wallis Rentals in connection with this agreement is true.

    25.3 This agreement constitutes the entire agreement of the parties and there are no other undertakings or agreements between the parties relating to the subject matter of this agreement.

    25.4 We reserve the right to vary the rates and conditions of hire at any time.

    26 DECLARATION

    I agree to be bound by these terms which I have seen and read.

    I further agree to be bound by the terms and conditions of the Insurance which I have seen or read.
